Terms and Conditions of El Bandido Yankee Giveaway

Official Rules

No purchase necessary to enter or win. void where prohibited. a purchase or payment will not improve your chances of winning. Participation in the giveaway constitutes your agreement to be bound by these “official rules” and the decisions of el bandido yankees. Individuals who participate in the giveaways or submit an entry are sometimes referred to herein as an “entrant(s).” No purchase, payment, or other consideration is permitted, and the winner is picked at random.

Eligibility

This Giveaway is open only to individuals who are twenty-one (21) years of age or older, and are local residents of Illinois, Wisconsin, Tennessee, Texas, Kansas, Arizona, Missouri, Michigan, California, Louisiana, Minnesota, Nevada, Colorado, Georgia, Florida and Indiana.

Sponsorship

The Giveaway sponsor is El Bandido Yankee (“Sponsor”). Sponsor will conduct the Giveaway substantially as described in these Official Rules. This contest has no affiliation with any liquor stores, bars or restaurants.

Entry Period

This Giveaway will have one (1) winner, the winner will be randomly chosen on February 25 at the barn after 5pm CST. The Giveaway will begin on 1/22/24 and ends on 2/25/24 at 5pm CST. Please note that timing variations may be applicable based on the announcement location.

How to Enter

During the Entry Period, Entrants will be asked to provide basic contact information, including full legal name, phone number, and email address (NOTE: Entrants must complete all required fields of the entry form with information that is valid on the date of the drawing to be eligible). All entries become the property of Sponsor and none will be acknowledged or returned.

Limitations on Entries

LIMIT ONE (1) ENTRY PER PERSON. No third party entry or online entry is permitted, Entrants must enter on the official El Bandido yankee form. Any person who attempts or otherwise encourages the entry of multiple or false contact information under multiple identities or uses any device or artifice to enter or encourage multiple or false entries, as determined by Sponsor, will be disqualified. Use of robotic entry devices is strictly prohibited. 

A valid form of identification verifying age will be required for the winner.

Grand Prize & Drawing

One (1) “Grand Prize” will be awarded, which consists of a signed Chris Chelios jersey. Sponsor shall not be responsible or liable in any way for any losses, or damages. If the winner is found to be ineligible or not in compliance with sweepstake rules, the winner will be disqualified and an alternate winner will be awarded the prize in a separate random drawing. Winner will be notified

by email from a Sponsor representative. Inability of Winner to contact Sponsor by email within seventy two (72) hours after selection, may result in disqualification of Winner and an alternate Winner may be selected in a random drawing at Sponsor’s discretion.

Odds

The selection of a Winner is predicated solely upon chance. All entrants have an equal opportunity to win, and the outcome is determined randomly, without any influence or skill-based criteria. The Winner is chosen through a random drawing or a chance-based mechanism, emphasizing the element of luck as the sole determinant.

General Terms

By entering this Giveaway, Entrants promise to abide by the Official Rules and decisions of Sponsor, which will be final and binding in all respects. Sponsor reserves the right, at its sole discretion, to refuse, disqualify or withdraw any entry at any time. Sponsor will not be responsible for any injury, damage, or loss of any kind arising out of Entrant’s participation in the Giveaway. Except where prohibited by law, by accepting the Grand Prize, Winner grants Sponsor a perpetual, worldwide, royalty-free license to use Winner’s name, photograph, voice, and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion, and other publicity purposes in any and all media now or hereafter known throughout the universe. The information provided by Entrants during the entry process, including but not limited to Entrant’s name and contact details, will be collected by Sponsor. Sponsor reserves the right to use this information to contact Entrants for contest-related communications, including Winner notifications, prize distribution, and updates related to the Giveaway. Entrants consent to receiving communications from Sponsor regarding this Giveaway and related matters. By entering the Giveaway, Entrants agree to receive email or SMS newsletters periodically from Sponsor. Entrants can opt-out of receiving this communication at any time by clicking the unsubscribe link. This Giveaway is subject to all applicable federal, state, and local laws. Entrants agree to follow these Official Rules. By entering this Giveaway, the Entrant agrees to the following statement 815 ILCS 525 Civil Code. 

Rights Granted by Entrants

By entering this Giveaway Entrants acknowledge that Sponsor, anyone acting on behalf of Sponsor, or the Released Parties will have the right, where permitted by law, without any further notice, review, or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the universe, each Entrant’s entry, including, without limitation, the entry and Winner’s name, portrait, picture, voice, likeness, image, or statements about the Giveaway, and biographical information as

news, publicity, or information and for trade, advertising, public relations, and promotional purposes without any further compensation. 

Limitations of Liability

The Released Parties are not responsible for late, lost, damaged, misdirected, incomplete, illegible, undeliverable, destroyed, and/or lost, late, misdirected, undeliverable, or incomplete entries and/or entries not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete or garbled computer or telephone transmissions, or for any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or providers, computer equipment, or entries not received by Sponsor on account of technical problems or traffic congestion on computer networks, or any combination thereof, including any injury or damage to any person’s computer related to or resulting from participating in the Giveaway or downloading any material for the Giveaway, or other telecommunications malfunctions which may limit an Entrant’s ability to participate. Sponsor may prohibit an Entrant from participating in the Giveaway or winning the Grand Prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, deception, or other unfair playing practices, or intending to annoy, abuse, threaten, or harass any other Entrants or Sponsor representatives. Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Giveaway is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Disputes

As a condition of participating in this Giveaway, Entrants agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Illinois having jurisdiction. Further, in any such dispute, under no circumstances will Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than Entrant’s actual out-of-pocket expenses (i.e. costs associated with entering this Giveaway), and Entrant further waives all rights to have damages multiplied or increased.

Nor do we collect any information about criminal convictions and offenses.

We also collect, use, and share aggregated data such as statistical or demographic data for any purpose. Aggregated data could be derived from your personal data but will not directly or indirectly reveal your identity. Retention of personal data

Unless we are required or permitted by law to hold on to your data for a specific retention period we will hold your personal data only for as long as is necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements, in particular:

  • Contact data is retained for as long as you are an active user of our platforms and for two years after you delete your account.
  • Financial data is retained for six years from the date of your last transaction with or through us. 
  • Usage data is retained for as long as you are an active user of our platforms and for two years after you delete your account.

Our services are aimed at children ages 13+ and you will only be able to create a driver profile if you are this age or above. We will process your personal data in the same ways described above and you will also have all the same rights as above.   • We will ensure that safeguards are in place when marketing any products or services to you and we will not carry out any profiling with your personal data.
